Terms of Use

These Terms of Use ("Terms") govern your access to and use of this website and any service made available through it (together, the "Website"), which is operated by FANTAGON HOLDINGS SDN. BHD. (Company No. 202201006650) of No. 50-01, 50-02, Jalan Perjiranan 4/5, Bandar Dato Onn, 81100 Johor Bahru, Johor, Malaysia ("Fantagon", "we", "us" or "our"). By accessing, browsing, registering an account or placing an order on the Website, you agree to be bound by these Terms and by our Privacy Notice. If you do not agree to these Terms, please do not use the Website.

These Terms apply to everyone who uses the Website. If you are a registered Fantagon distributor, these Terms — together with the Code of Ethics and the compensation plan published on the Website — set out the terms on which you hold your distributorship.

1. Eligibility and Account Registration

• You must be at least 18 years of age and legally capable of entering into a binding contract to register an account.
• You must provide information that is accurate, current and complete, including your legal name, identification document number, contact details and bank account details, and you must keep that information up to date.
• One person may hold only one distributor account. Registering duplicate accounts, or registering an account in another person's name without that person's authority, is a breach of these Terms.
• You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at support@fantagon.app if you believe your account has been accessed without your authority.
• Where your registration is completed on your behalf by your sponsor, you remain responsible for reviewing and confirming the accuracy of your details when you activate the account.

2. Permitted Use of the Website

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to access the Website for your own use and, if you are a distributor, for the conduct of your Fantagon business. All other rights are reserved.

You must not:

• use the Website for any unlawful purpose, or in breach of the Direct Sales and Anti-Pyramid Scheme Act 1993, the Consumer Protection Act 1999, the Personal Data Protection Act 2010 or any other applicable law;
• impersonate any person, misrepresent your rank, income or affiliation with Fantagon, or use a display name that is misleading, offensive or infringes the rights of others;
• attempt to gain unauthorised access to any account, server, database or part of the Website, or probe, scan or test its security;
• use any robot, spider, scraper or other automated means to access the Website, mine data, or collect information about other members;
• reverse engineer, decompile, copy, mirror, frame or create derivative works from any part of the Website;
• upload or transmit any virus, malware or other harmful code, or any content that is defamatory, obscene, harassing or unlawful;
• interfere with the proper operation of the Website or impose an unreasonable load on our infrastructure.

3. Intellectual Property

The Website and all of its content — including text, graphics, photographs, product imagery, layout, software, and the Fantagon and 五行圣殿 / Five Elements Sanctuary names, logos and marks — are owned by or licensed to Fantagon and are protected by copyright, trade mark and other laws. Nothing in these Terms transfers any ownership right to you. Registration as a distributor does not grant you any right in our trade marks, copyright works or trade secrets beyond the limited promotional use permitted under these Terms and the Code of Ethics.

4. Content You Submit

You retain ownership of any content you submit to the Website, including profile photographs, wish inscriptions and messages. By submitting content you grant Fantagon a worldwide, royalty-free, non-exclusive licence to host, store, reproduce and display that content to the extent necessary to operate the Website and provide the service to you. You confirm that you own or have the right to submit the content and that it does not infringe the rights of any third party. We may remove any content that breaches these Terms, but we are not obliged to monitor or review submitted content.

5. Product Information and Health Disclaimer

Product descriptions, ingredient information and the five-element content published on the Website are provided for general information only. Fantagon products are intended to support a healthy lifestyle and are not intended to diagnose, treat, cure or prevent any disease. Nothing on the Website constitutes medical advice. Consult a qualified healthcare professional before using any product if you are pregnant or nursing, taking medication or under medical care.

6. Income Disclaimer

Fantagon does not guarantee any income, profit or level of success. Any figures, ranks, leaderboards or examples shown on the Website are illustrative and are not a representation of what you will earn. Actual results depend on individual effort, selling ability, market conditions and the way you build your organisation.

7. Orders, Pricing and Payment

• All prices are shown in Malaysian Ringgit (RM) and are subject to change without notice. Prices and product availability displayed on the Website do not constitute a binding offer until we confirm your order.
• You must provide accurate payment details and, where you pay by transfer, an authentic payment proof. Submitting a falsified or altered payment proof is grounds for immediate suspension and for reporting to the relevant authorities.
• We may refuse, limit or cancel any order — including after an order has been confirmed — where we reasonably suspect fraud, duplicate accounts, payment default, or a breach of these Terms or the compensation plan.
• Bonus and commission amounts are credited to your wallets in accordance with the published compensation plan, and are subject to any withholding required by law, including the 2% withholding under Section 107D of the Income Tax Act 1967 where applicable.
• Withdrawals from your wallets are processed within the published withdrawal windows and are subject to the applicable minimum amount and processing fee. Payment can be made only to a bank account held in your own name.

8. Cancellation, Returns and Refunds

• Cooling-off period — you may cancel a purchase without giving a reason within 10 working days of signing the order or receiving the goods, whichever is later, as provided under the Direct Sales and Anti-Pyramid Scheme Act 1993. Notify us in writing (email is sufficient) quoting your order number and member code.
• Refund — where you cancel within the cooling-off period and return the goods unused, unopened and complete, we will refund the full amount you paid within 21 days of receiving your notice and the returned goods, and we will bear the return delivery cost.
• After the cooling-off period — we accept returns only where the goods are defective, damaged in transit, not what you ordered, or past their expiry date. Contact us within 7 days of delivery with photographs; we will replace the goods or refund you in full and bear the delivery cost both ways.
• Method of refund — refunds are made to the payment method you used. Any part paid from a wallet is returned to that wallet; cash refunds are paid by bank transfer to an account in your own name.
• Effect on bonuses — where an order is refunded, any bonus already paid on that order is recovered from the relevant wallets, and if a balance is insufficient it is set off against future bonuses. The PV and rank volume generated by that order are reversed.

9. Referral Links and Replicated Pages

We may provide you with a personal referral link, member code or NFC plaque page. These remain the property of Fantagon and are licensed to you for as long as your account is in good standing. We may suspend, transfer or withdraw any such link or page, and we do not guarantee that any particular address will remain available. You must not present a replicated page as an independent or official Fantagon corporate website.

10. Suspension and Termination

We may suspend or terminate your access to the Website, and your distributorship, with immediate effect where you breach these Terms or the Code of Ethics, or where required by law. You may close your account at any time by written notice to us. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply after termination.

11. Third-Party Websites and Services

The Website may link to or rely on third-party services, including payment gateways, logistics providers and analytics tools. We do not control and are not responsible for the content, products, privacy practices or fees of any third party. A link is not an endorsement. Your dealings with a third party are between you and that third party.

12. Disclaimer of Warranties

The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, timely, secure or error-free, or that any defect will be corrected. Nothing in this section limits any right you have under the Consumer Protection Act 1999 that cannot lawfully be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, Fantagon and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, data or business opportunity, arising out of or in connection with your use of the Website. Our total aggregate liability in connection with the Website is limited to the total amount you paid to us in the six months preceding the event giving rise to the claim. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

14. Indemnity

You agree to indemnify and hold Fantagon harmless against any claim, loss, liability or reasonable legal cost arising from your breach of these Terms, your misuse of the Website, any content you submit, or any representation you make about Fantagon products or the earning opportunity that is not authorised by us.

15. Privacy

Our collection and processing of your personal data is governed by the Privacy Notice, which is issued under the Personal Data Protection Act 2010 and forms part of these Terms.

16. Changes to the Website and These Terms

We may modify, suspend or discontinue any part of the Website at any time. We may also amend these Terms; the amended version takes effect when published on this page. Your continued use of the Website after publication constitutes acceptance of the amended Terms. Where a change materially affects your rights as a distributor, we will notify registered members.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. You and Fantagon submit to the exclusive jurisdiction of the courts of Malaysia. Before commencing proceedings, please raise your complaint with us at support@fantagon.app so that we can attempt to resolve it through our complaint handling process, as described in the Code of Ethics.

18. General

• If any provision of these Terms is held to be unenforceable, the remaining provisions continue in full force.
• Our failure to enforce any provision is not a waiver of that provision.
• You may not assign or transfer your rights under these Terms without our prior written consent.
• These Terms, together with the Privacy Notice and the Code of Ethics, form the entire agreement between you and Fantagon in relation to the Website.
• These Terms are published in English. If we publish a translation, the English version prevails in the event of any inconsistency.
